MEMPHIS ADVENTURE BOOT CAMP (MEMPHIS ABC) AND/OR ADVENTURE FITNESS MEMBER / PARTICIPANT ACKNOWLEDGMENT AND ASSUMPTION OF RISK AND FULL RELEASE FROM LIABILITY OF MEMPHIS ABC, OR IT’S EMPLOYEES, CONTRACTORS, OFFICERS, OR OWNER/S, OR LOEB PROPERTIES. PARTICIPANT ACKNOWLEDGES THESE PHYSICAL ACTIVITIES INVOLVES THE INHERENT RISK OF PHYSICAL INJURIES OR OTHER DAMAGES, INCLUDING, BUT NOT LIMITED TO, HEART ATTACKS, MUSCLE STRAINS, PULLS OR TEARS, BROKEN BONES, SHIN SPLINTS, HEART PROSTRATION, MISCARRIAGE, KNEE/LOWER BACK/FOOT INJURIES AND ANY OTHER ILLNESS, SORENESS, OR INJURY HOWEVER CAUSED, OCCURRING DURING OR AFTER PARTICIPANT PARTICIPATION IN THE PHYSICAL ACTIVITIES. MEMBER FURTHER ACKNOWLEDGES THAT SUCH RISKS INCLUDE, BUT ARE NOT LIMITED TO, INJURIES CAUSED BY THE NEGLIGENCE OF AN INSTRUCTOR OR OTHER PERSON, DEFECTIVE OR IMPROPERLY USED EQUIPMENT, OVER-EXERTION OF A MEMBER, SLIP AND FALL BY MEMBER, OR AN UNKNOWN HEALTH PROBLEM OF MEMBER. MEMBER AGREES TO ASSUME ALL RISK AND RESPONSIBILITY INVOLVED WITH PARTICIPATION IN THE PHYSICAL ACTIVITIES, MEMBER AFFIRMS THAT MEMBER IS IN GOOD PHYSICAL CONDITION AND DOES NOT SUFFER FROM ANY DISABILITY THAT WOULD PREVENT OR LIMIT PARTICIPATION IN THE PHYSICAL ACTIVITIES. MEMBER ACKNOWLEDGES PARTICIPATION WILL BE PHYSICALLY AND MENTALLY CHALLENGING, AND MEMBER AGREES THAT IT IS THE RESPONSIBILITY OF MEMBER TO SEEK COMPETENT MEDICAL OR OTHER PROFESSIONAL ADVICE, REGARDING ANY CONCERNS OR QUESTIONS INVOLVED WITH THE ABILITY OF PARTICIPANT TO TAKE PART IN ACTIVITIES. BY SIGNING AT THE BOTTOM OF THIS PAGE, MEMBER/PARTICIPANT ASSERTS THAT HE OR SHE IS CAPABLE OF PARTICIPATING IN THE PHYSICAL ACTIVITIES. MEMBER AGREES TO ASSUME ALL RISK AND RESPONSIBILITY FOR NOT EXCEEDING HIS OR HER PHYSICAL LIMITS. PARTICIPANT UNDERSTANDS PHOTOS OR VIDEO MAY BE TAKEN DURING THE COURSE OF MY INVOLVEMENT IN BOOT CAMP, WHICH MAY BE USED FOR PROMOTIONAL PURPOSES AND AGREES TO SUCH USE. MEMPHIS BOOT CAMP MEMBER/PARTICIPANT IS ALSO AWARE THEY MIGHT NOT HAVE SAME TRAINER EVERY CAMP.

Automatic Payment Authorization Policy: This is a month-to-month membership and is considered active and ongoing until cancelled as described in the Cancellation Policy. All $19 trial (nineteen dollar trial) periods will start the day registration is received and will automatically be converted into a month-to-month membership 10 days after processing date unless cancelled via email to amanda@dextertenisonfitness.com prior to the one sign-up anniversary date (10 days). All payment options for month-to-month and one-year commitment pricing, as well as all memberships will continue on an automatic basis until notice of cancellation is received per the Cancellation Policy. Commitment Pricing Option Terms:One-year commitment pricing ($117/month) requires a one-year commitment to Memphis ABC and member shall be charged via an automatic monthly payment authorization each month as described in the Automatic Payment Authorization Policy. Should the member cancel services prior to the one year anniversary date, member shall be required to pay the difference between the month-to-month pricing ($167/mo) and one-year pricing ($117/mo) options for every month that they have attended Memphis ABC. Member agrees to and allows Memphis ABC, Adventure Fitness, and/or Dexter Tenison Fitness to debit or charge the difference in fees using the credit card or debit card on file upon receipt of notice of cancellation. Memphis ABC, Adventure Fitness, and/or Dexter Tenison Fitness reserve the right to use a collection agency to collect these fees if necessary, and any and all extra charges and expenses incurred through the collection process will be the sole responsibility of the member. Cancellation Policy: Memphis ABC/Adventure Fitness member must give written notice of cancellation by email to amanda@dextertenisonfitness.com a minimum of 5 (five) business days (Monday through Friday) prior to the payment debit date. Please note: Even if member notifies an instructor they are still required to send an email to amanda@dextertenisonfitness.com. Save a record of that email to serve as your cancellation receipt. Prepay memberships are non-refundable. I (member) authorize Memphis ABC/Adventure Fitness/Dexter Tenison Fitness to debit the balance owed on my account upon receipt of notification of cancellation.
